3. Product Information and Pre-Orders

All products listed on our website are pre-orders unless otherwise specified. By placing a pre-order, you agree to the following:

• Products are expected to ship in Early March 2026, though this date is subject to change
• We will notify you via email of any significant delays or changes to the shipping timeline
• Product descriptions, images, and specifications are provided for informational purposes and may vary slightly from the final product
• Prices are listed in U.S. dollars and are subject to change without notice until your order is confirmed

4. Ordering and Payment

4.1 Order Process

When you place an order through our website, you will receive an email confirmation. This confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

• Product availability issues
• Errors in product or pricing information
• Suspected fraudulent activity
• Inability to verify payment information

4.2 Payment

Payment is processed at the time of order through our secure payment processor, Stripe. We accept credit cards and Apple Pay. By providing payment information, you represent and warrant that:

• You are authorized to use the payment method provided
• All payment information you provide is accurate and complete
• You will pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred

4.3 Taxes

Applicable sales tax will be calculated and added to your order based on your shipping address. Tax rates are determined automatically at checkout.

5. Shipping and Delivery

5.1 Shipping Locations

We currently ship only within the United States. We do not offer international shipping at this time.

5.2 Shipping Costs

We offer free shipping on all orders within the United States for pre-orders. Standard shipping rates apply when preorder ends.

5.3 Delivery Timeline

Pre-orders are expected to ship in Early March 2026. Once your order ships, delivery typically takes 5-7 business days. You will receive a tracking number via email when your order is dispatched.

5.4 Shipping Address

You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by you. If a package is returned due to an incorrect address, you may be charged for re-shipping.

6. Returns and Refunds

6.1 Pre-Order Policy

All pre-orders are final sale. Once your order is placed and payment is processed, we do not offer refunds or cancellations. This policy exists because we use pre-order funds to manufacture products specifically for your order.

6.2 Defective Products

If you receive a defective or damaged product, please contact us at orders@67-bottles.com within 14 days of delivery with:

• Your order number
• Photos of the defect or damage
• A description of the issue

We will evaluate each claim on a case-by-case basis and, at our discretion, offer a replacement or refund for genuinely defective products.

7. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, product designs, and software, is the property of 67 Bottles LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

You agree not to use our website for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include but are not limited to:

• Attempting to gain unauthorized access to our systems
• Using automated systems to access the website (bots, scrapers, etc.)

• Engaging in any activity that interferes with other users' access to the website

9. Disclaimer of Warranties

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR WEBSITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PRODUCTS PURCHASED FROM US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of our website shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Los Angeles County, California.

14.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and 67 Bottles LLC individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 67 Bottles LLC regarding your use of our website and products, and supersede all prior agreements and understandings.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
